Govt issues notification of Hussain Asghar as probe officer in Hajj corruption case

Following the stern orders of the Supreme Court (SC) on Tuesday, the government has appointed Hussain Asghar as Director FIA to continue probing the Hajj corruption scam.

The Federal Secretary Establishment Suhail Ahmed presented Hussain Asghar’s notification of appointment as Director FIA before the court after the break at 11:30 AM.

The notification presented before the court describes that Hussain Asghar has been appointed as Director FIA to probe the Hajj corruption scam on directives of the SC.

After receiving notice of appointment from the Federal Secretary Establishment, the SC ordered that the department should render full support to Hussain Asghar and his previous investigation team should also be restored to probe the Hajj corruption scam.
The court ordered that DG FIA Tehseen Anwar Shah and Hussain Asghar to appear before the court today (Wednesday). 
The court said that the court is not showing any interest for the recovery of the 560 million rupees in the Hajj corruption case.
Five member special bench of the apex court headed by Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry and comprising Justice Mian Shakirullah Jan, Justice Tariq Pervez Khan, Justice Khilji Arif Hussain and Justice Amir Hani Muslim heard the suo moto notice against the corruption committed in Hajj operation of last year.
When the hearing of the case started on Tuesday the secretary establishment presented the explanatory statement in the court; upon which the chief justice showed annoyance said that the court had ordered to bring the notification of the appointment of Hussain Asghar and had not sought the explanation.
Chief justice asked the secretary establishment to read out the Article 190 of the Constitution, which bound him to act on the orders of the court; meanwhile chief justice in his remarks said that all the institutions are bound to act upon the orders of the court, adding that the orders of the court are final and there is no way but to implement these orders.
He said that the behaviour of the government with the court is beyond understanding, adding that today again DG FIA not appear before the court.
Chief justice said that the contempt of the court is being committed while sitting in front of court.
He said that if the chief executive is hurdle in the implementation of the court orders the court could deal him while remaining in the limits of the constitution.
The court asked the secretary establishment to bring the notification of appointment of Hussain Asghar till the 11: 30 AM; meanwhile court summoned the DG FIA but the attorney general informed the court that DG FIA is in Karachi regarding an important work and he has informed the registrar SC.
Chief justice in his remarks said that for the sanctity of the institutions the court is awarding another chance for brining the notification of Hussain Asghar, adding that if the secretary would fail to comply the orders of the court the contempt of court would be completed against him today.
On this point Justice Shakirullah Jan said that was it so important for DG FIA to visit Karachi had it not possible that he might left for Karachi after appearing in court, adding that this pretest of Tehseen Anwar is not acceptable for the court.
The court said that the DG FIA was present in Islamabad on Monday but could not appear in court.
Additional Director General FIA Chaudhry Manzoor Ahmed informed the court that he has no contact with DG FIA.
On this Justice Tariq Pervez said that attorney general acting on political advice, adding that he should fulfill his duties being the chief law officer of the country.
Justice Amir Hani Muslim inquired from the attorney general weather he showed the court orders to DG FIA; upon this the AG said that the court has not summoned DG FIA and the hearing of NICL case has been adjourned for indefinite period that is why he has not appeared in the court.
On this chief justice said that the court had verbally directed him to appear before the court.
The court asked the AG why he not informed the government institutions that they are bound to act upon the orders of the court.
After the break the Federal Secretary Establishment presented the notification of the appointment of Hussian Asghar in the Hajj corruption case.
The secretary establishment said that Hussain Asghar needs not to wait for his replacement, as IG of Gilgit Baltistan, and automatically he is released of his previous responsibilities after issuance of the official notification.

The court said that it is very important case and corruption in this case been committed at large scale and this case earned bad name for pakistan in the world.
The SC ordered that DG FIA Tehsin Anwar Shah must appear before court on Wednesday (today) and adjourned hearing the Haj corruption case till today (Wednesday). SANA
