ISLAMABAD: Additional Director Federal Investigation Agency (FIA), Zafar Ahmad Qureshi, who is investigating the high profile Rs5 billion National Insurance Company Limited scam, has submitted in the Supreme Court that he is being continuously harassed by PML-Q leadership and after his retirement, he would be at the mercy of the politicians against whom he has proceeded in performance of his official duties.
Qureshi has also submitted in the apex court that six legal notices have been served upon him by the PML-Q leadership through various lawyers. But one of the lawyers has denied in writing that he signed and sent any legal notice to him.
The documents submitted in the court also reveal that sufficient evidence has been collected against Moonis Elahi and whenever FIA asked critical questions from Moonis he started shivering.
Zafar Qureshi’s special note attached with the NICL scandal report says: “All actions have been taken in consequence of the orders of the Honorable Supreme Court of Pakistan and in performance of official duties as Additional Director General FIA for which the undersigned enjoys immunity u/s 8 of FIA Act, 1975. However six legal notices have been sent to me from all over Pakistan on behalf of PML-Q leadership and a defamation suit has been filed against me at Lahore. The harassment by the petitioners is evident from these proceedings alone.”
“It is pertinent to state that one of the first notices dated 14-02-2010 was copied by many other lawyers across the country and sent to me again and again through different names. Furthermore, when a reply to one of the legal notices dated nil was sent on my behalf, the alleged sender Sardar Mehmood Khan Advocate gave a written response to me through a lawyer, categorically stating that he had not issued any legal notice and the same was a mystery to him. It is evident that the petitioners are forging names of persons and sending illegal notices to the undersigned in order to create an aura of harassment.”
“It is imperative that this honourable court may declare that I and not personally liable for my actions during the investigation of NICL cases- as I am an FIA officer and enjoy immunity for the same. After my retirement, I would be at the mercy of the petitioners against whom I have had proceed in performance of my official duties.”
Regarding Moonis Elahi, Zafar Qureshi has written that during the course of investigation conducted so far, sufficient documentary/oral evidence has come on record showing that Moonis Elahi s/o of Ch Pervaiz Elahi is the real beneficiary of the account and he had received this amount from the crime proceeds held by accused Mohsin Habib Warraich from deals with NICL.
“During the course of interrogation, the accused failed to negate the allegations and could not produce any rebuttal of the evidence recorded by FIA. Whenever any critical question regarding narrating the story, his relation with accused Mohsin Habib Ullah Warriach was asked, he starts shivering and perspiring. Upon asking why he is in such condition, he explained that he is diabetic since early age. He uses insulin regularly,” the reports says.
