KARACHI : Sindh High Court was Tuesday assured that Federal Investigation Agency will takeaction according to law on complaint seeking initiating high treason proceedings against ex-President Gen. (rtd) Pervez Musharraf for allegedly subverting Constitution on November 3, 2007.
A division bench, comprising Justice Gulzar Ahmed & Justice Imam Bux Baloch, also disposed of constitutional petition following this undertaking rendered by Deputy Attorney General on petition filed by Agha Syed Attaullah Shah, Chairman of Rah-e-Raast Trust, a social welfare organization. He approached court to seek action against Gen (retd) Pervez Musharraf for allegedly abrogating Constitution on November 7, 2009.
Impleading Interior Ministry & Director General FIA as respondents, petitioner submitted then Army Chief, Pervez Musharraf, who was also President, proclaimed emergency & suspended constitution of country. He contended this act was against provisions of Constitution. Therefore, petitioner sent complaint to FIA authorities under Section 5 of FIA Act 1974, requesting to initiate contempt proceedings against Musharraf under High Treason (Punishment) Act 1974. FIA had powers to initiate high treason proceedings against any person, who abrogates Constitution under FIA Act 1974.He stated neither Interior Ministry nor FIA take any action against Pervez Musharraf and prayed to direct respondents to take action under law.Previously, SHC directed petitioner, Federal and Provincial Law Officers to argue on maintainability of petition in high court, as Supreme Court had already passed judgment upon action of November 3, 2007 in case (PLD 2009 Supreme Course 8791 Sindh High Court Bar Association v/s Federation of Pakistan).On Tuesday, Federal Law Officer for Federation, Provincial Law Officer for Provincial Government were present.SHC division bench in its order observed: “It seems that a complaint has been made by petitioner to Director General FIA on August 11, 2009 copy of which is filed as annexure “B” with petition regardingtaking of an action against ex-President (Retd) Gen. Pervez Musharraf of high treason. Learned DAG submits that FIA will make enquiry into complaint made by petitioner and will take action in accordance with law.” It ordered: “The petitioner’s counsel is satisfied with above statement of DAG and submits that petition be disposed of in same term. The petition in above term stands disposed of alongwith listed application.”
