PESHAWAR: An additional sessions judge (ASJ) on Monday issued release order of Aaron Mark DeHaven, a US national arrested on charges of illegal stay, and directed him to deposit a sum of Rs2 million in the account of a ‘Nazir’ of the court before securing his release from the prison on bail.
ASJ Altafur Rehman Khan had reserved the decision on bail application of the US national on March 4. The ASJ in its six-page decision also directed DeHaven not to leave the jurisdiction of the court without informing the provincial government through station house officer of Town Police Station.
The judge in its decision stated, “The US national has overstayed in Pakistan beyond the period, which he was permitted. “The offence he has been charged with carries imprisonment, which may extend up to five years and fine.
“The petitioner offence does not fall within the prohibitory clause of Section 497 of CrPC (Criminal Procedure Code). The petitioner does not come in the prohibitory clause of CrPC and thus there is no statutory bar on bail to the petitioner.”
