Supremacy of constitution, rule of law vital for democratic set up: CJ Iftikhar Mohammad Chaudhry

Chief Justice Iftikhar Mohammad Chaudhry has said that the supremacy of the constitution and rule of law is vital for the democratic set up of the country, adding that it is responsibility of Judiciary to kept every institution in her premises.

The full court meeting arranged on the occasion of retirement of Senior Judge of Supreme Court Justice Javed Iqbal was chaired by the Chief Justice Iftikhar Mohammad Chaudhry here on Thursday.
Chief Justice speaking on the occasion said that law has supremacy in the democratic systems and to provide justice to masses is a pious profession, adding that the constitution of a country impose sanctions on the desired authorities of parliament, judiciary and executive.
He said that the process of accountability provides base for a democratic system, adding that supremacy of law is the basic need of a democratic society.
The chief justice said the rule of law in the country would be upheld, and justice will be provided fearlessly without any discrimination.

The chief justice further said that the integrity of the country rests on the rule of law, and violation of the constitution must be avoided.

Chief justice lauded the efforts and performance of Justice Javed Iqbal and said that he worked very hard and with loyalty during his service, adding that his services would be remembered for years.
Addressing the reference Justice Javed Iqbal said that he had completed his responsibility to protect the constitution and nobody think about the breach of constitution, adding that in the current situation it is need of hour that all institutions should perform their duties within their limits.
He said that the explanation of constitution is the right of judiciary, adding that there is no chance of clash of institutions.
He said that he had learned a lot from wisdom of chief justice, adding that nothing is needed to say regarding the supremacy of parliament.
He said that judiciary, parliament and bureaucracy have their limits and the parliament has supremacy over them.
Vice Chairman Pakistan Bar Council Latif Afridi while addressing the reference said that the lawyers’ would defend the law at any cost and they are with judiciary for the supremacy of law, meanwhile he said that the orders of judiciary were not followed by the government.
President Supreme Court Bar Association Aasma Jahangir said that she has no sympathy with those who breach the constitution, adding that they would continue struggle for the supremacy of law and constitution at any cost.
Meanwhile talking to a private TV channel Vice Chairman Pakistan Bar Council Latif Afridi said that the lawyers are very conscious about the non-implementatuion of court orders, adding that they are considering to convene the meeting of the all bar associations of the country to devise the strategy for against the government.
He said that the lawyers would not hesitate to start movement in favour of judiciary, adding that the attitude of the government towards the court decisions is unacceptable.
Replying a question Latif Afridi said that in response to any possible presidential reference against the chief justice of the Pakistan, justice Iftikhar will remain the chief justice until the decision of the reference.
He said that the government is bound to act upon decision of the Supreme Court, which already has been made, adding that the possible presidential reference would not stop implementation of these decisions. SANA
