ISLAMABAD: Supreme Court has showed its annoyance over delay in
chairman’s appointment of the commission constituted for search of
missing persons and asked the government that why it could not induct
head of the committee so far. The court instructed Additional Attorney
General that appointment of chairman should be made before 26
September.
The court also issued instructions that bench may be
informed the reasons of inordinate delay as the matter has been
lingering on since three months.
The two-member bench
comprising of Justice Nasir-ul-Mulk and Justice Tariq Pervez resumed
the hearing the case regarding missing persons. During proceedings,
here on Thursday.
Justice Nair-ul-Mulk asked Additional
Attorney General K.K. Agha to tell the court about those people who are
putting impediments in the appointment of chairman.
Additional
Attorney General K.K. Agha apprised the court that consultation is
going on for the appointment of Chairman of Commission constituted for
missing persons and the names of few retired judges are under
consideration for the slot. So the court may give some time to the
government.
Agha during his arguments said that the matter
requires full response towards it and the government is fully aware of
its sensitivity so some time would be required for making appointment.
He assured the court that appointment would be made before next date of
hearing.
On the he submitted the report complied by Ministry of
Defence in this regard. He told the court that the matter of Fazal Rabi
was nothing to do with missing persons as he was kidnapped due to
enmity in business. “In addition to this there are eight more cases
including Masood Janjua and Faisal Faraz , which were killed in
Afghanistan”, he added.
On which Chairperson Defence of Human
Rights Amna Masood Janjua told the court that her husband is in the
custody of secret agencies , which are giving life threats to her and
her children. She requested the court to make security arrangements for
her. Additional Attorney General said on the occasion that he had told
the court several times that Masood Janjua is not detained by any
agency . As a matter of fact he had soft corner for Al-Qaida and he was
killed in Afghanistan.
Justice Tariq Pervez said on the
occasion that it is the responsibility of the state to provide
protection to the citizens. He said that the statement of Dr Imran, who
was released from the captivity of agencies is on record that Masood
Janjua was in the custody of agencies. If these agencies are denying
then who will tell that where is he. If he was killed , then the
evidences may be brought to the notice of the court.
On the request from Additional Attorney General to grant some time , the court was adjourned for two weeks. Online
