Supreme Court rejects plea for separating Moonis Elahi matter from NICL corruption case

ISLAMABAD: Supreme Court (SC) while rejecting the application for separating Moonis Elahi matter from NICL corruption case had maintained that the trial court should decide the case on merit.

A 3-member bench of SC presided over by the Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry took up NICL corruption case for hearing Wednesday.
During the hearing the SC rejected the plea seeking separation of Moonis Elahi matter from the case and maintained all the matters were tied with Moonis Elahi, therefore, no special treatment could be meted out to him. “Rule of law has to be ensured and he can be provided relief under law only”, SC remarked.
Waseem Sajjad and S.M Zafar counsel for Moonis Elahi and FIA officers appeared in the court during the hearing of the case.
Azam Khan, legal advisor to FIA told there was difference in the report of former investigation officer Zafar Qureshi. Matters of serious nature have been pointed out in the audit report and Zafar Qureshi should study them as well, he said.
“You should not say investigation had not taken place. Zafar Qureshi got recovered 1.88 crore rupees”, CJP observed.
“In Zafar Qureshi report we have been dubbed as murderers. He should reply to this question”, SM Zafar said. “We however keep this matter pending”, CJP remarked.
The court while pending the matter of placement of names of wife and daughter of Habib Ullah Warraich in ECL has adjourned the hearing of the case for indefinite period. Online
