Supreme Court of Pakistan on Friday granted time till August 9th for issuance
of notifications over the PCO judges’. The court showed annoyance over
non-implementation of the court orders on PCO judges’, adding that
there is no need of any summary for the implementation of court orders.
Chief Justice Iftikhar Muhammad Chaudhry in his remarks said that
the court would not allow anyone to let down the judicial authority.
The five-member special bench headed by Chief Justice Iftikhar
Muhammad Chaudhry heard the suo moto notice against the
non-implementation of SC orders regarding the PCO judges’; meanwhile
the federation was represented by Senator Babar Awan.
The federal counsel informed the court that a summary with regard to
the PCO judges’ judgment has been sent to the Prime Minister, upon
which the Chief Justice retorted that this was a court order and no
summary required for implementation of the court order.
Babar Awan informed the court that the Prime Minister was not in
Islamabad and requested two days time. The Supreme Court summoned the
law secretary and attorney general and gave the government time till
August 9.
In its May 18 decision, the Supreme Court had declared that seven
High Court judges who had taken oath under the PCO were no judges
anymore. The government had assured the court that it would implement
the decision but the judges were never de-notified so far.
The chief justice said that according to newspapers information, the
court verdict was criticized in the cabinet meeting, adding that if the
government would say that the decision is not right then it would not
be implanted?.
It is worth mentioning here that in its May 18 decision, the Supreme
Court had declared that six High Court judges who had taken oath under
the PCO were no judges anymore, including one judge from PHC, one judge
form SHC and 4 judges of LHC, meanwhile the next hearing of the case
would be on Monday 9 August.
The further hearing of the case would be held on Monday and the
awarded time for de-notification of PCO judges’ would end on Tuesday. SANA
