ISLAMABAD: Supreme Court (SC) has granted two days more to the
government to implement its decision against PCO judges and issue
notification on de-qualification of PCO judges immediately.

5-member bench of SC presided over by Chief Justice of Pakistan (CJP)
Iftikhar Muhammad Chaudhry and comprising Justice Mian Shakir Ullah,
Justice Tassadaq Hussain Jillani, Justice Sarmad Jalal Usmani and
Justice Amir Hani Muslim took up the case for hearing.
Federation
counsel Babar Awan, Attorney General (AG) and law secretary Masood
Chishti appeared in the court. The court while expressing displeasure
over non-issuance of de-qualification notice in respect of PCO judges
remarked court’s decisions are being ridiculed.
“Court be
informed about the reasons behind non implementation of its decisions.
This court is supreme and its every decision be implemented. Court’s
authority would not be allowed to be failed. If government says the
decision is not acceptable to it then “will it not be implemented”, SC
observed.
The CJP inquired from federation counsel it has been
heard that this verdict was criticised in cabinet meeting. Babar Awan
said these were sheer media reports.
CJP remarked “ acting
secretary Sultan Shah misguided the government by sending the summary.
As to why secretary Sultan Shah be not awarded punishment for
misguiding court. This is court’s decision and it should stand
implemented automatically”.
Babar Awan said he was at Sultan Shah hospital, therefore, he could not appear in the court.
CJP
remarked the hearing was taking place today therefore, he moved to
hospital. There was no need to send this summary to parliament
following the approval of 18th amendment. It seemed as if all had
signed summary without studying it, CJP further observed.
Baba Awan said Sultan Shah had written in the summary that the matter be referred to supreme judicial council.
On
the assurance from Babar Awan that notification would be issued within
two days the court granted 2 days more to government to de-notifiy the
PCO judges within two days. Online
