Muzaffarabad High Court accepted the Muttahida Qaumi Movement
(MQM) application formally for hearing regarding the postponement of
elections three seats of Azad Jammu and Kashmir Legislative Assembly on
Tuesday and court sought written reply from Chief Election Commission
tomorrow (Thursday).
Former parliamentary leader of MQM in Tahir Khokhar submitted his
plea that in which he contended that the postponement of elections for
indefinite period is illegal on refugee seats in Karachi and holding of
elections would be illegal on the special/reserved seats before
lections on postponed seats were not completed.
Chief Justice Ghulam Mustafa Mughal accepted the plea after hearing
the arguments from the counsel of Khokhar and issued notices to all
parties including Chief Election Commission to submit their written
reply before June 30.
MQM filed an application in the court to challenge the legal status
of postponement and to stop the holding of elections on special seats
and maintained in the application that postponement of elections on LA
30,LA 36 is illegal just 24 hours before and Chief Election
Commissioner misuse his power and postponed elections on federal
government pressure.
Applicant contended in the application that elected representatives
used their votes to elect the five women, one Ulema, technocrat and
overseas Kashmiris so elections on reserved seats would be illegal
until the completection of electoral college and it is violation of
basic rights.
MQM contended in the plea that Chief Election Commissioner cannot
postpone elections according to constitution and can call forces
including army and Rangers and elections should be conducted again
where, rigging was reported and power was misused.
A large number of workers including Member National Assembly (MNA) Iqbal Qadri Advocate of MQM were present on the occasion.
Meanwhile Sindh High Court stated during the hearing of the plea of
the MQM filed on Monday against the deferment of three seats of
refugees said that holding election is not responsibility of court but
it is responsibility of Election Commission of AJK.
The Sindh High Court adjourned the hearing of case till 30th June
(tomorrow) saying that the court would issue orders if the Muzaffarabad
High Court would fail to issue orders regarding the holding of
elections.
Talking to media after hearing MQM counsel Barrister Farogh Naseem
demanded that court should reject the report of DIG regarding the law
and order situation of Karachi, adding that the judges said in their
remarks that to maintain law and order is reasonability of state. SANA
