Aitzaz says SC & HC judges’ can not perform official duties till two years after retirement

Former president of Supreme Court Bar Association and leader of People’s Party Chaudhry Aitzaz Ashen has said that any judge of Supreme Court or High Court can not perform official duty fro two years after the retirement , adding that the position of the NAB chairman will be considered as official duty.
Commenting on the reports of appointment of justice (retd) Javed Iqbal as Chairman NAB, Barrister Aitzaz Ahsan said that in the absence of NAB chairman the NAB has practical existence.

In an interview with a private TV channel Barrister Aitzaz Ahsan said that according to the Article 207 of the constitution any retired judge of Supreme Court or High Court till the period of two years cannot accept any position in service of Pakistan.
He said that any position which claim salary or perks also comes under this article, adding that the position of chairman NAB is administrative position and the work of chairman NAB is like the investigating officer like IG police.
He said that the duty of chairman NAB is collection of evidences and this could not be termed as the judicial work.
He said the duty of chairman NAB is not give the final decision; his duty is to send cases in court not giving a decision by him. He said that NAB does not exist, because chairman NAB is not present.
He said that the SC is asking the government to appoint NAB chairman so that the cases pending with the NAB could be decided. Responding a question Aitzaz Ashen said government filed review appeal against the SC verdict against NRO, so therefore it is a live and 17 judges of the apex court could review the review appeal as the earlier judgment was announced by 17 judges.
