ISLAMABAD: Government has written a letter to Chief Justice of
Pakistan Justice Iftikhar Muhammad Chaudhary asking him to nominate any
judge of Supreme Court in the commission to probe the Abbottabad
incident.
The letter was forwarded to Registrar Supreme Court
through Secretary Law Division , which would be conveyed to Chief
Justice on Monday(today).
According to details the government
the constitution of commission to investigate midnight operation by US
marines commandos at Abbottabad in which Al-Qaeda Chief Osama Bin Ladin
was killed. However the consultation of Chief Justice was considered
imperative to complete the legal requirement .
Earlier, under
the light of resolution adopted by joint session of the parliament, the
government had established a five-member investigation commission under
the chairmanship of Justice Javed Iqbal but it was not activated as
legal prerequisites were not fulfilled at that time as the government
did not consult with the Chief Justice of Pakistan to appoint Justice
Javed Iqbal as the head of inquiry commission.
Supreme Court of
Pakistan earlier , in Fakhar-un-Nisa case, declared that any serving
judge of the Supreme Court could not be appointed member of any
commission without consultation of CJP.
Government has
dispatched the letter to Chief Justice on 18 June through Masood
Chishti , Secretary Law Division, which was received by the Registrar
Supreme Court , who will submit to Chief Justice today(Monday). The
letter asked CJP to appoint any serving judge of supreme court as head
of the commission.
The Chief Justice after going through the
details of the letter would nominate any judge of Supreme Court for the
headship of the commission according to his will.
It is
pertinent to mention here that that the commission would probe all the
aspects of Abbottabd incident and suggest such measures that will
prevent the repetition of such episodes in future. It would be the most
important commission in the history of Pakistan after Justice
Hamood-ur-Rehman Commission, which would discuss important issues
