Supreme Court orders appointment of ATC judges within 2 days in Karachi

The Supreme Court of Pakistan on Tuesday ordered Advocate General Sindh to issue orders to appoint judges for Anti Terrorism and Banking courts within two days as the bench noted the shortage of judges in Sindh province.

Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry in his remarks said conspiracies were in the working against the country, adding Karachi was a mini-Pakistan.
A five-member special bench of the SC comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Anwar Zaheer Jamali, Justice Sarmad Jalal Usmani, Justice Amer Hani Muslim and Justice Ghulam Rabbani heard the suo motu notice regarding the target killing incidents of Karachi here on Tuesday.
Justice Anwar Zaheer Jamali asked why judges were not appointed even after the recommendations by the Chief Justice Sindh High Court in 2009 and 2011.
Chief justice said that everything is in front of courts, adding that chief justice Sindh high court has recommended the names of the judges why the government was not appointing the able and honest judges.
Chief justice said that the during the current situation the cases are being delayed, adding that retired colonel was appointed as SP in the cit, adding that retired colonel was appointed as SP in the city, adding that there is thinking of the masses in city that paying of 1000 rupees is easy or death is easy.
Justice Anwar Zaheer in his remarks said that politically influenced people are recruited and these persons receive salaries while sitting in home without performing duties.
Chief justice said that why the government not restores its writ, adding that why the police personnel were sent to Charka Goth on a private vehicle, adding that it was the mistake of the command.
Chief justice questioned from CCPO Saud Mirza that if you would have been taken action against the perpetrators of the target killings the circumstances of the city could not have been like today; meanwhile chief justice questioned from Saud Mirza weather the report of the special branch was wrong.
Earlier, during proceedings, Chief Justice, Iftikhar Muhammad Chaudhry remarked that the report of the joint investigation team on Ajmal Pahari raised questions about national sovereignty.
The Chief Justice asked the Advocate General Sindh Abdul Fatah Malik and Inspector General (IG) Sindh Wajid Durrani if they had read this report. He further asked what should be saved, the country or the government.
The CJ also questioned what measures IG Sindh had taken after this report, since it contained information regarding the organization Pahari was affiliated with. He remarked that Karachi was the economic hub of Pakistan and the country could not progress unless the city was secure.
Justice Ghulam Rabbani pointed out that if no action was to be taken, then why were joint investigation teams formed?
The chief justice asked IG Sindh if Kamran alias Maduhri was arrested in connection with the firing on police in Chakra Goth, or had he been released. The IG replied that he was arrested, to which Justice Amir Hani Muslim asked if his charge sheet had been presented in the court.
IG Sindh informed the court that Kamran was injured and thus could not be presented to which Justice Amir Hani Muslim replied that he should be presented with a medical certificate. The Chief Justice asked Advocate General Sindh, “What to save—country or government.”
The Advocate General Sindh during the hearing requested to the court that the video of Lyari torture cell should not be made public.
Why Kamran Madhuri and Sohail were not named in the FIR of the mini bus arson incident, the chief justice asked from the I.G. Sindh. The Chief Justice also asked about the whereabouts of Kamran Madhuri. Kamran Madhuri has been admitted at hospital for treatment, Sindh police chief informed the court.
Chief Justice of Pakistan Iftikhar Muhammad Chaudhry said that the city was bleeding but nothing was done to stop the killings. During the hearing, the CJP questioned Sindh Advocate General Abdul Fatah Malik why the killers of 306 people were not arrested.
The court said that many people were frowning at the bench formed by the Supreme Court to hear the Karachi killing case. The advocate general requested the court to give him 15 minutes at the end of the hearing to clarify his position.
The CJP said that the court wanted to hear from him a lot and ample time would be given to him, adding that the advocate general was hiding many details.
The advocate general said that he is unable to show the footage in the court due to the objectionable content. He went on to add that the footage of torture cell could be shown in the chamber. The CJP asked from him whether he wanted to save the government or the country.
Supreme Court Bar Association (SCBA) President Asma Jahangir during the arguments said that extortionist (bhatta) culture was introduced by the MQM, adding the party which had a large terrorist network, was creating troubles for ten years now; but, no action was being taken against it.
Asma alleged it was Muttahida that always took initiative to deteriorate the situation in the metropolis, adding MQM was still involved in bhatta activities in the city. Everyone knows who are behind the assassination of journalist, she observed.
SCBA President said, “Rangers take up investigations themselves instead of handing criminals to police after they arrest them.”
She said that after the one statement of Dr Zulfiqar Mirza 16 persons were killed in one day, adding that the role of media was also not positive regarding the Karachi situation; meanwhile the court adjourned the further hearing of the case till today (Wednesday). SANA
