Supreme Court directs indiscriminate operation against criminals in Karachi

Supreme Court of Pakistan has ordered the IGP Sindh for an indiscriminate operation against criminals in Karachi and adjourned the hearing of suo motu case till September 13.

Five-member bench of the apex court headed by Chief Justice Iftikhar Muhammad Chaudhry and comprising Justice Anwar Zaheer Jamali, Justice Sarmad Jalal Usmani, Justice Ameer Hani Muslim and Justice Ghulam Rabbani heard Suo moto notice on Friday.
The Chief Justice Chaudhry remarked that police can control crimes but not willing to do so, adding that all parties including Pakistan Peoples’ Party (PPP), Muttahida Qaumi Movement (MQM) want peace in the Metropolis but dead bodies are still being recovered from the city.
The chief justice asked Attorney General Maulvi Anwar-ul-Haq that ISI has submitted its report, why IB report was not submitted to the court.
The Attorney General told the court the report was being compiled and it would be presented soon.
The CJ asked why Chakra Goth accused Ataf and Fahim were released over insufficient evidence and what kinds of the cases were registered against them.
The court also summoned Sindh IG and inquired about details into Chakra Goth incident and kidnapping of a Lyari-based footballer.
The IGP replied that 40 percent appointments in police have been made on political grounds. Under these circumstances, police were trying to control the situation.
Chief Justice Chaudhry further asked why police could not determine the identity of a dead body found from Pakistan Bazaar.
The IGP told the court that most of the murders were taking place due to personal enmities.
IG Sindh, Wajid Durrani said that 40% of police officers had political affiliations. The Chief Justice remarked the court had ordered that shoulder promotions be stopped but this was not implemented in Sindh.

The Chief Justice calling the I.G. Police Sindh said that the two accused of the Chakra Goth killings were freed due to police’s wrong identification.
The Sindh Police chief informed the court that the investigation officer of Chakra Goth incident has been suspended, while the SHO has been transferred. He said that ethnicity is the cause of the most killings in Karachi. The police chief said that his hands were tied as he has to implore the home department for transfer of a SP rank official.
In his remarks, Chief Justice Chaudhry said all stakeholders want peace in the city, adding that the court wants to empower police by ensuring protection.
Advocate General Sindh, Fateh Malik presented a summary of different cases from July 24 till August 24. The Chief Justice directed the Advocate General to provide details of the firing on a bus in Banaras and the kidnapping of footballers in Lyari.
The Chief Justice said that whatever the cause of the killing, the Police would have to take action on the crime. Why the police is unable to take action the Rangers assistance, the Chief Justice asked. The court be informed if the department facing any political pressure on the issue, the CJP asked.
The Chief Justice said, the Sindh Police chief that all political parties want peace in Karachi and assured him full support of the court. The Chief Justice ordered the police chief to take indiscriminate action against the criminals.
Advocate General Sindh informed the bench that the man kidnapped in Karsaz area has been recovered, adding that 38 out of 44 cases have been registered.
Earlier, Chief Justice Iftikhar had criticized Sindh Advocate General, blaming him of not putting his heart into his job.
Speaking about problems faced by law enforcement agencies in the city, Inspector General Sindh Police Wajid Durrani said that cellular network companies and PTA did not cooperate with the police and often did not provide the police with the required data.
City Police officer Saud Mirza said that surrounding cellular phones and related networks, mobile phones of Chinese brands were untraceable, and that customs authorities should be notified in this regard.
Saud Aziz further said that all banks are also not cooperating with police by denying sharing the data ATM machines recording as well as information about the credit cards.
Responding to which, Chief Justice Iftikhar Chaudhry said that thousands of shipping containers would not have been stolen if customs authorities were working properly. He said that details about problems facing Karachi police should be provided to the court by PPO, in writing and court would direct the government to provide all instruments and facilities to the police.
Regarding other issues faced by police, Wajid Durrani requested the court to order the State Bank of Pakistan to cooperate with police.
Meanwhile talking to a private TV channel Attorney General Maulvi Anwarul Haq said that the report of the IB has been submitted in the court regarding Karachi situation. Later, the court adjourned the hearing till 13 Sept.
Talking to newsmen at SC Karachi Registry counsel for federation Babar Awan said that federation and executive could not be termed as failure due to the current situation of Karachi, adding that Parliament took notice of Karachi situation prior to the SC notice.
Babar said that that constitutionally the judiciary has been separated from the executive and any interference in executive powers will be violation of the constitution.
Former federal minister said that the government will not leave the path of reconciliation. “Whether any person taunt us or call us cowards, we would not leave the path of reconciliation” he added
Awan said that the federal and provincial governments could not be held responsible for killings in Karachi. SANA
