ISLAMABAD: Six convicted persons in Musharraf attack case have filed
constitutional petitions in Supreme Court (SC) against what they
described their unjust trial praying apex court to recommend government
to constitute an independent tribunal to ensure equitable trial.
Naik
Arshid Mehmood of Pakistan army, Nawazish of former technician Pakistan
Air Force, civilian Ghulam Sarwar, Mushtaq Ahmad and Ikhlas Ahmad have
filed separate petitions making federation and defence ministry
respondents. They prayed that fundamental human rights are violated by
not conducting equitable trial in military courts. Therefore it may be
recommended to the government to set up independent military tribunal
so that protection of fundamental human rights and just trial be
ensured. “ Our trial was not conducted judiciously in Musharraf attack
case and ends of justice were not met , they requested.
In the
petitions it was prayed that section 133 of army act-1952 be declared
ultra vires of constitution and recommendations be made for making
amendment in , Army Act-1952, Air Force Act –1953 and Naval
Ordinance-1961. Right to filing appeal for one time against army
tribunal decision in SC be also granted. Online
