People don’t keep in mind its consequences while committing wrong doings: CJP Iftikhar Muhammad Chaudhry

ISLAMABAD: Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry has remarked people don’t keep in mind its consequences when they commit wrong doing.

CJP gave these remarks while presiding over 11-memebr larger bench of SC during the course of hearing of presidential reference in Bhutto case here Wednesday.
CJP said facts are coming before us and they are embarrassing for us. But it is binding on us to remain within the parameters of constitution, he further remarked.
Presidential counsel Babar Awan presented investigation record in respect of Bhutto case in the court.
“Lahore High Court (LHC) conduced trial of Bhutto in criminal case in his absence. This method is adopted only in military court. LHC played the role of summary trial court. Conspiracy to kill Bhutto was hatched in summary trial court. PCO judiciary was a party in Bhutto case”, he said.
Constitution is an excellent book to the extent of surprising us but what happened with it later is a separate tale”, Justice Jawad S Khawaja said.
CJP said “ court would not let any thing remain under carpet. Punjab police should bring all the record”.
CJP expressed resentment over non production of record by Punjab Police saying when a case was filed then as to how it became revived in 1977. What Babar Awan is saying then seems correct that story was invented to reopen the case. If the situation is like this then replies to the questions contained in presidential reference can be given without going into facts”.
CJP remarked “record with regard to case be presented in the court. If the situation is like this then original FIR will not be lying with police which should have been presented during trial. Statement of Ghulam Hussain is also important that on what stage he became approver.
CJP inquired from Babar Awan if Justice Moulvi Mushtaq Hussain was also injured in the accident wherein Chaudhry Zahoor Elahi was murdered.
Replying to this question Presidential counsel Babar Awan said he did not know about it.
CJP inquired “ if it is in your knowledge that the pen which was used in signing Bhutto execution orders was highly valued.
Babar Awan said chief justice of LHC Moulvi Mushtaq Hussain which was hearing Bhutto case became claimant.
On inquiring from CJP about court’s proceedings, Babar Awan told that trial was not being conducted in Bhutto case but preparations were being made to murder him. The then prosecution counsel Farooq Badar wanted to file affidavit, he said.
The court said there was no need for filing affidavit in this case.
The court while summoning the FIR of Bhutto case and record regarding filing the case has adjourned the hearing till today.
