THE Lahore High Court on Thursday sought reply from federal government in two weeks on a petition, challenging the recent increase in petrol prices.
Chief Justice Ijaz Ahmad Chaudhry issued the order on a petition moved by Mateenul Haq Chaudhry advocate.
On Wednesday, the CJ had dismissed the petition as the notification of petrol price raise was not annexed with it.
The petitioner filed the plea again on Thursday after getting the required notification.
He submitted that the impugned notification regarding the increase in POL prices, issued by the federal government, was unlawful, ineffective, ultra vires over the rights of citizens.
The petitioner said that despite of a pending writ petition against the increase in the prices of oil and petroleum lubricants, the Oil and Gas Regulatory Authority (Ogra) and the federal government were going to implement the impugned notification by approximately 9.9 percent raise in POL prices. He said the act of the respondents was tyranny against the downtrodden of Pakistan. He said the matter was of grave and of public importance and the court should take notice of it on a priority basis.
The petitioner pleaded that the respondents be directed to withdraw the impugned notification. He also requested the court that status quo be granted in the interest of public at large.
Dual office case adjourned: A full bench of the Lahore High Court on Thursday adjourned until March 8 the hearing of several writ petitions challenging holding of dual-office by President Asif Ali Zardari as petitioner’s counsel AK Dogar continued his lengthy arguments.
The bench, headed by Chief Justice Ijaz Ahmad Chaudhry, comprised of Justice Iftikhar Hussain Chaudhry, Justice Umar Ata Bandial and Justice Ijazul Ahsan. The petitions were filed by Pakistan Lawyers Forumís (PLFís) Engineer Ghulam Jillani and Advocate Asif Mehmood Khan.
The petitioners contended that the President, being head of the state, is constitutionally bound to maintain an impartial, neutral and non-partisan posture to deal with any situation in the best national interest of the nation.
Asif Ali Zardari is head of a political party and adopts on occasions absolute posture of the party leader and serves party interests, which is contrary to the character of his constitutional office, they said. The court was requested to declare Zardari as disqualified to hold the dual office.
