Supreme Court summons ZA Bhutto case record from Ichra police station

ISLAMABAD : Supreme Court of Pakistan has summoned the complete record of Zulfiqar Ali Bhutto case from Ichra police station and adjourned the hearing of the presidential reference till today (Wednesday.

The Court directed counsel of the federation Babar Awan to collect copy of the FIR registered at Ichra Police Station Lahore besides supplementary of the police in the case and present before the court. However if the record is not handed over to him the court will itself summon the record.
An eleven-member larger bench of the Supreme Court headed by Chief Justice Iftikhar Muhammad Chadhury headed the presidential reference about ZA Bhutto murder case.
During the hearing, Chief Justice Iftikhar Muhammad Chadhury said in his remarks that apparently Masood Mehmood was the mastermind of Nawab Ahmed Kausri’s murder case, adding that it would be observed that at what stage Masood Mehmmod involved in ZA Bhutto case. CJ said that this reference is a matter between president and court, adding that it is an international level case and all facts would be bring out.

Counsel of the federation Babar Awan continued his arguments on legal and constitutional position of the approver in the Bhutto case. He said that judges of the Lahore High Court were sub-judice and late Bhutto raised this issue before the court through an application. However, the court did not consider the application and completed the trial.
Babar Awan argued that Masood Mehmood was arrested as approver against ZA Bhutto and Marshal Law authorities provided him a questionnaire before the recording of confessional statement.
CJ replied that Massod Mehmood give confessional statement during the investigation of railway bomb blast case and his statement are contained 100 pages and his statement is very important in the case.
During the course of hearing Justice Javed Iqbal said to Babar Awan that your case is revolving around the Masood Mehmood statement and Babar Awan replied that no, his case is revolving around the behavior of Maulvi Mushtaq because in this case he was not working as a judge.
 The Court observed that the application of late Bhutto must had been entertained prior to trial.
The Court observed that the reference has been filed by the President to seek opinion of the court therefore it will be better to not try to make it controversial. Babar Awan told the court that Prime Minister Syed Yousuf Raza Gilani wanted to appear in the court in the Bhutto reference case.
Chief Justice also asked from Babar Awan that Zalifqar Ali Bhutto had what differences with Justice Maulvi Mushtaq Ahmed.
Meanwhile the court adjourned the further hearing of the case till today (Wednesday). SANA
