ISLAMABAD : Zulfiqar Ali Bhutto’s (ZAB) presidential reference was
filed to get a legal opinion of the Supreme Court on
case not a fresh review, said Chief Justice Iftikhar Muhammad Chaudhry during
Thursday hearing.
On Thursday an eleven-member bench of the Supreme Court resumed hearing of
presidential reference on Zulfiqar Ali Bhutto’s case. Babar Awan continued his
arguments.
The Chief Justice said in his remarks during ongoing hearing that the ZAB
reference is being heard to give a legal opinion, under the constitution, on the
case and not to review it from the scratch.
He added that one cannot go beyond the constitution and Zulfiqar Ali Bhutto’s
stature is well known by everyone even little children of the country.
Chief justice ordered the concerned authorities to present the missing record
of the ZA Bhutto case, adding that without the record of the police the court
could not move forward.
The court ordered the DG FIA, IG Punjab Police and IG Railways to present the
missing record in court after recovering it.
The court directed the attorney general of Pakistan Justice (retd) Maulvi
Anwarul Haq to hold meting with the heads of the above mentioned institutions,
adding that the registrar of the SC would also cooperate with them.
Babar Awan said in his replying arguments that he will not go beyond limits
of the constitution while carrying forward ZAB case.
During hearing, the Chief Justice pointed out that no case was carried out
over that FIR in 1977 which was registered in 1974 as that was closed in 1975
after completion of the investigation.
He added that apparently the case was started over another issue in 1977 but
later on Nawab Kasoori’s case was attached with that.
The Supreme Court adjourned hearing of ZAB case till May 09 as Babar Awan
continued his arguments before the court. SANA
