Supreme Court directs agencies to produce Adyala Jail prisoners’ in court

Supreme Court of Pakistan (SC) during the hearing of Adyala Jail prisoners’ case has directed secret agencies to produce seven prisoners under custody, before the court on February 9.

A three-member bench of the SC headed by Chief Justice Iftikhar Muhammad Chaudhry and comprising Justice Khilji Arif Hussain and Justice Tariq Parvez heard the case of the eleven missing prisoners of the Adiala Jail filed by Mst. Ruhaifa through advocate Tariq Asad on Monday.
The prisoners were convicted of attacking army installations including the GHQ.
Dr. Tariq Asad, ASC appeared on behalf of the petitioner while Raja M. Irshad, Sr. ASC, Ch. M. Yaqoob, Joint Secretary, Ministry of Defence and Comdr. M. Hussain Shahbaz, Director (Legal) appeared on court notice.
During proceedings the counsel for the army and intelligence agencies, Raja Arshad informed the court that four of the eleven prisoners were dead while four among others have been admitted in Lady Reading Hospital Peshawar while three are in Internment Centre Parachinar. They are in custody of the provincial government not in custody of secret agencies, he added.
Raja Irshad said that the prisoners admitted in hospital can not be produced before the court without the permission of the hospital administration, however he said that court may direct to provincial government to produce them before the court.
In response to that Chief Justice said that “you have taken these prisoners so you have to produce them before the court”.
Court asked that how these four prisoners were died while they were in custody of secret agencies and during the hearing of case earlier the agencies had inform the court that these were kept into custody under Army Act.
The Supreme Court has ordered that the remaining seven prisoners be presented before the court on February 9 and those prisoners who are receiving medical treatment be allowed to meet their families.
Counsel for the respondent was directed to file reply, explaining the circumstances under which four persons have been died and reply the allegation alleged against the respondents and also produce the seven persons before this Court on 09.02.2012.
Court has maintained that In the meantime, the learned counsel for the respondent, if possible, shall arrange meeting of the relatives with the persons, who were admitted in the Lady Reading Hospital, Peshawar.
Later the court issued notices to Attorney General and Advocate General Khyber Pakhtoonkhwa and adjourned the case till 09.02.2012. SANA
