KARACHI - Sindh High Court Thursday dismissed petition seeking direction from government to hand over American citizen, Raymond Davis, a CIA contractor, to United States as petition became infructuous following his release in double murder case of two Pakistanis in Lahore.
Raymond Davis was released on March 16, 2011 after paying Rs 100 million each to families of victims, Faizan & Faheem, whom he gunned down on January 27, 2011 in limits of Lytton Road police station, Lahore.Petitioner, Rana Faizul Hasan, President of United Human Rights Commission of Pakistan, approached court impleading Secretaries of Interior, Defense, Law & Justice & Parliamentary Affairs Ministries, ex-Minister Foreign Affairs Shah Mehmood Qureshi & PPP Information Secretary Ms Fouzia Wahab as respondents.He submitted Ms Wahab at press briefing in Karachi claimed accused Raymond Davis enjoyed diplomatic immunity & he possessed valid diplomatic visa. He stated this claim later proved to be false & Davis was not member of US diplomatic staff.He argued despite existence of Vieanna Convention of Diplomatic Immunity 1961, U.S. itself had not pardoned & convicted a Georgian Ambassador for killing a US citizen in road accident Washington in 1997. Similarly, Georgia convicted & sentenced American in 1999 for killing its citizen in road accident.He stated Raymond Davis committed crime by killing two Pakistanis & did not enjoy diplomatic immunity,therefore, he should be convicted and sentenced. He prayed to direct official respondents from handingover Davis to US.On Thursday, petitioner Rana Faizul Hasan was present.SHC division bench said in its order: “The petitioner present in person and states that petition has become infructuous. Consequently, petition is dismissed as having become infructuous.”
