Supreme Court declares RPPs as illegal; directs action against Parvez


Supreme Court announcing verdict in Rental Power projects case has declared all the contracts of the rental power projects as illegal.

Apex Court has directed NAB to take legal action against former minister for Water and Power Raja Pervez Ashraf and ex power secretary Shahid Rafi, meanwhile court has observed that government is taking decisions against the basic rights of masses.
The chief justice said that legal proceedings should be carried out against all those involved in the corruption.
The verdict is on cases involving alleged corruption in contracts of and payments to rental power plants detected by the Nepra.
The applicants, Minister for Housing and Works Faisal Saleh Hayat and MNA Khawaja Muhammad Asif had appeared in person while the government departments and sponsors and owners of the rental power plants were represented by their counsels.
The judgment was reserved on December 14 last year and announced on Friday by a bench headed by Chief Justice Iftikhar Muhammad Chaudhry.
The court ordered that the Principal amount paid to the RPP companies should be taken back with interest. The court also ordered action against than water and power minister Raja Pervez Ashraf and other people involved into the matter. NAB should act against all persons involved under the law, the bench said.
While ordering to shut all the RPPs, Justice Iftikhar Muhammad Chaudhry declared all the contracts as illegal and issued an order to shut all rental power projects in the country.
To provide expensive power to the people is violation of the rights of the people of Pakistan and NEPRA has failed to protect the rights of the people, said the verdict.
Two rental units Karkey Gulf and Naudero-II has not returned the advance payment as yet. RPPs were producing only 130 mw power for the energy-starved country.
It may be pertinent to mention that Supreme Court had taken suo motu notice on the petition filed by Federal Minister for Housing and Works, Faisal Saleh Hayat alleging huge corruption in the award of RPPs contract. SANA
